Despite an appeals court ruling, the state Supreme Court will decide whether urine tests can be used to find out if a driver is under the influence of drugs.
The state has an approved method for breath and blood tests for DUI, but not for urine.
"I can't understand a decision that would uphold the use of scientific evidence that has no standards," said Richard Essen, senior partner with, Essen, Essen, Susaneck, Canet and Goodis, P.A., the Miami, Florida law firm specializing in DUI defense. "I think they are dead wrong about this."
